Our correspondence address is Office 5, Bourne Park, Exeter Park Road, Bournemouth BH2 5BD. For the purposes of these Terms and Conditions, the business will hereafter, be referenced as Pogo.
2 Applicability
2.1 These legal terms (English law) are between you the customer (You/Your) and us. (We/Us/Our/Pogo) applies when you use our hotel booking and other services, which includes our mobile App (iOS or Android) or our Website (https://pogo.travel).
2.2 When you make your booking using our App or Website, you must accept these Terms and Conditions and also confirm that you have read our Privacy Policy: https://pogo.travel/privacy and Cookie Statement: https://pogo.travel/cookies
3 What We Do
3.1 Pogo provides a hotel search facility that takes the hassle out of booking rooms.
4 Age and Legal Capacity
4.1 The hotel booking services offered are only for Users who are 18 years of age or older, and any registration, use or access to the Service by anyone under 18 is strictly prohibited and in violation of these Terms and Conditions. If you are reserving accommodation on behalf of other people including family, a party or friends you must have their consent to make the booking using the App or Website.
4.2 When using the App or Website you can only use the Services offered if you have the ability to make payments and are fully able and competent to enter into this agreement including obligations, affirmations, representations, and warranties set forth in these Terms and Conditions and to comply with them.
5 App and Website
5.1 Pogo takes all reasonable care in providing accurate information, but we can’t guarantee that everything on it is accurate (as we get information from the Service Providers). Our App and Website are not recommendations or endorsements of any Hotel, or its products, services, facilities, vehicles, etc or other travel product suppliers. Therefore, Pogo, can’t be held responsible for any errors, any interruptions, or any missing bits of information - although we will do everything we can to quickly correct or fix them online, as soon as we are informed.
5.2 When you engage with any hotel through our App or Website it is at your own risk, and Pogo does not have any responsibility in the unlikely event that anything goes wrong with your booking. Pogo has no control over the hotels and any travel product providers.
5.3 Any general travel advice we give through the App or Website should be used alongside your own research on where is safe and appropriate to travel.
6 Contractual Relationships
6.1 When you make a booking through the Pogo App or Website it is with the Service Provider. Pogo is not a ‘contractual party’ to your Booking.
6.2 Pogo does not provide, manage or own the hotels that you can access through its App and Website. Details concerning service providers such as facilities, sustainability, house rules and pricing, availability and cancellation policies, are all based on what is given to Pogo.
6.3 The Pogo App and Website only displays property that has a commercial relationship with us, and it may not always show every product or service.
7 Suspension of Service
7.1 We may, from time to time temporarily suspend our App and/or website for repair or maintenance in order to update or upgrade features or content.
8 Your Information
8.1 Please be honest with Pogo, it is really important that you ensure that all the information you enter on the App or Website is accurate and correct.
8.2 We may use your email address and other details to send you messages, such as changes to the App or Website and offers. If you do not want to receive such email messages, you may opt out or change your preferences. However, opting out will still permit Pogo to send you details about your bookings and anything else you have requested.
9 Limitation of Our Liability
9.1 We will not be liable to any user for any loss or damage if our App or Website is unusable either completely or in-part for any period of time.
9.2 Our App and Website are for domestic and private use only. We will not be liable for any indirect loss or indirect damages to you or for loss of profits, business interruption or loss of business opportunity. We have taken every reasonable step to ensure that the information we provide is accurate and up-to-date. However, we cannot accept any liability for any errors or omissions or reliance on any content displayed.
9.3 Pogo will also not be liable for:
Any loss or damage caused by a virus or other harmful material that may infect your computer, smartphone or device from your use of our App or Website or if you download any content.
Inaccurate information published about a hotel or other service provider or the actions of a hotel or other service provider.
Mistakes with email addresses and phone numbers.
Force majeure or other event beyond our control including civil emergencies, war, disturbance, strikes, natural and nuclear disasters.
We assume no responsibility for the content of any websites we provide links to. Such links should not be interpreted as an endorsement by us of those linked websites.
The App and Website or our social media pages could contain information uploaded by other users of them. This information has not been moderated by us and the views expressed by other users does not represent our views.
10 Complaints
10.1 Any booking you made is between you and the hotel, Pogo’s role is limited to promoting hotel and leisure facilities on its App and Website. Therefore, because the contract is between you and the hotel, and we are not a party to it, you must contact the hotel direct to raise any complaint.
10.2 If your complaint concerns the functionality of the Pogo App or Website, the best way to get in touch with us is by email at hello@pogo.travel, this helps keep a permanent trail of the conversation with you.
11 Copyright
11.1 The App and Website contains material which is either owned by or licensed to us. This material includes items like the design, content, layout, properties and look. All worldwide rights are reserved. Any copying or other infringements will be treated as a breach of copyright.
11.2 Reproduction is strictly prohibited other than for your personal use or to draw the attention of others to content on our site.
11.3 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. We may withdraw our linking permission at any time.
12 App and Website Users
12.1 You must not create and upload any information that contains viruses or other computer programs that could damage software or hardware or that may affect the use of computers. This includes not violating any applicable laws, not creating false reviews and not posting pornographic or offensive material.
12.2 You must not attack the App and/or Website through a denial-of-service attack (DoS attack) or a distributed denial-of service attack.
12.3 Any breaches will be immediately reported to the appropriate law enforcement agency and Pogo will also seek civil damages to the maximum possible.
13 Updating The Terms
13.1 We may update these terms of use at any time by updating this page. The updated terms will be effective from the date they are posted. If you don't agree with these changes, you can let us know and if you have an account, we can remove it.
14 Breach of the Terms and Conditions
14.1 If you breach these Terms and Conditions, Pogo will take action as appropriate. This could include Pogo issuing a warning, blocking your account or even commencing legal proceedings.
15 Legal Jurisdiction
15.1 The Pogo Terms and Conditions have been construed in accordance with the laws of England. You agree that the courts of England will have exclusive jurisdiction for any dispute in relation to any claim or matter concerning these Terms and Conditions, App and the Pogo Website.
